The following is an email from Ian Bayes at Equity, regarding a query from a PMA member regarding UK Video buy-out for Death Comes to Pemberley. I am forwarding for information for anyone who has clients involved:
On the 18th June this year I did agreed a to request made by Joanie Blaikie on behalf of Origin Pictures regarding video sales advances, as per the terms of Appendix TA clause 5 of the PACT/Equity Television Production Agreement. Please refer to the extract below of the email that I sent to Joanie.
Further to our recent email exchange and your request to pay a sales advance of 2 x 4% and 1 x 5% to the artists contracted on the production for the US, Rest of World and UK Video rights due to Endemol being unable to distribute royalties, I can confirm that Equity agrees to this request.
In June I was not aware that Endemol had licensed BBC Worldwide to distribute videos in the UK, it’s also possible that this agreement may not have been in place. If I had been aware of the agreement in June I would have rejected the request for a 5% advance payment for UK video and I would have insisted that royalties be paid.
I am now of the opinion that the 5% advance should be converted into an advance payment against a 17% royalty pay away.
I shall raise this matter with PACT and update you accordingly.
