Some of you will remember a discussion at a recent Artists’ Meeting and online about companies wanting to engage artists for unspecified periods. Having raised the issue with Equity they have sent the following statement clarifying and enforcing the terms of the PACT TV agreement. (This will also be sent to PACT and the CDG).
From Equity:
We continue to be contacted by artists and their representatives to express their concern that some companies are not adhering to the terms of the PACT/Equity TV Agreement as it relates to the method of engagement. Some companies are seeking to engage artists for unspecified periods which in practice means that without firms dates within the overall period of engagement it makes it virtually impossible for the agents to secure other work on behalf of their clients as there is uncertainty as to when the artist(s) will be called.
I would urge PMA colleagues to accept engagements under the terms of the PACT TV Agreement via clause (T8)1-Nominated periods and/or 2-unspecified periods or 3-Eight weeks or more continuous engagement.
We accept that there will always be negotiations around availability of the artists over a period of engagement and the artist and agent must be able to secure work when not already on 1st call. Engagements must be offered to PMA colleagues under the aforementioned clauses and producers must work with agents to accommodate requests to accept other work when not already contracted which at the same time enables the producer to accept or reject the requests from the agents.
