I’m afraid despite significant efforts to get these into order, there are still issues with the Waitress contracts.

I have again raised these with management, but as this has been going on for some time thought it would be helpful for agents to know what the concerns are, so that if management attempt to rely on these clauses we can put up a united front to challenge their validity.

Holiday – 4.a sets out holiday entitlement incorrectly, the entitlement is 28 days. 4b then says they will follow the agreement, which is incoherent.

10. b and 10. f purport to give the right to use photographs in perpetuity. Under clause 4.3.1 of the West End Agreement use photographs of anyone who has left the production must cease as quickly as practicable, so these clauses are a clear breach. 10. C then says they will use photographs in accordance with the agreement, which is incoherent.

21 refers to policies which are incorporated into contract. I would be interested to see these, and for agents to flag any concerns about them.

22.b reassures me a bit, as it makes clear that the West End Agreement will be followed.

11.d is a different type of concern – it states clearly that the Agreement will be respected, but if agents agree to it they are signing away the ability to negotiate above minimum terms for filming of a documentary or reality show.
